Concluding thoughts

The chapter has made it clear that currently, pregnant women entering prison and ergo their babies, born and unborn, are being failed for the most part. The benefits of the recent welcome Review of Operational Policy on Pregnancy, Mother and Baby Units and Maternal Separation (Ministry of Justice, 2020) in the UK remains to be seen. There needs to be a similar robust review in Ireland with a stated intention of improving the care and outcomes of pregnant criminalised mothers and their babies. Desired outcomes in both jurisdictions would be achieved via, at the least, a mandatory cohesive informed response which centres the rights and well-being of the child as well as the mother. In a considered reform of the landscape for criminalised pregnant mothers and their babies, alternatives to prison MBUs as we understand them must be considered. Options which promote the mother–child bond, whilst responding holistically to the mother and her needs and simultaneously meeting the needs of the unborn and newly born child, must be explored. As such, outcomes for mothers would be improved, enabling them to reach their full potential, significantly improving outcomes for their babies and ensuring the best possible start to life – as all children equally deserve.
